These Conditions of Sale apply to the sale of products and services by arteycostura.net

We kindly ask you to read these conditions carefully before submitting your request to arteycostura.net. By submitting your order to arteycostura.net, you agree to be bound by these conditions.

1. THE CLOTHING ALTERATIONS ON-LINE SERVICE

The responsibility of the customer in contracting the service:

It is the exclusive responsibility of the client, the veracity of the data provided to arteycostura.net, regarding the taking of the measures that you are requested on the service contract page. If as a result of an error in the provision of such data or measures, the settlement is not to the satisfaction of the clients or there is irreparable damage to the pledge, arteycostura.net, will not be responsible for such damage or unsatisfactory arrangement.

Therefore we strongly recommend to our clients, that despite the abundant information through guides and videos that we provide for taking the measures we offer in each product or service, do not hesitate to consult us in case of doubt, go through any of the means that we put at your disposal, either via contact form, email or by phone during business hours that appear on all the pages of the online services contracting area. We will be happy to assist you.

The service of collection and delivery at home of garments.

The service of collection and home delivery of the garments that will be subject to any of the services of arrangements, will be free for those customers who are in the Community of Madrid and for orders whose total cost is equal to or greater than € 27 and as long as the weight of the package does not exceed 4 kg.

We recommend our customers to group the contracting of services in the same order whenever possible so that this service does not involve any cost. If the order is less than 27 €, the cost will be fixed and will have a value of 9.25 €. ( For Madrid only)

In any case, the client will have constant information about the cost or free shipping throughout the contracting process.

For other areas of Spain, the collection and shipping service will also be free for those orders that exceed the value of € 100.

The client can indicate his preference for the date of collection of the shipment in each service he hires. If the customer mistakenly indicates a mismatched date for a service within the same order, the date will be taken as the date closest to the date of contracting the service, however, we will try to contact before proceeding to send the service. the parcel, to confirm the date of collection of the garments.

The collection service will always be provided on business days and at least 48 hours from the date on which the online contracting of the service occurs.

Once the garments are collected at the client’s address, they will have this information through their account, in the “orders” section. In addition, you will be informed about the evolution of the status of contracted jobs by email.

Once the arrangement is made (between 5 and 7 days) after the garment (s) arrive at our workshop, we will proceed to send the garments already fixed to the customer’s home, which will be informed through the page web and emails.

It is the client’s responsibility to be at the address to collect the arranged garments. If the delivery could not be carried out for reasons beyond arteycostura.net, you would be left with a notice in your mailbox by the parcel company with the information to agree on new delivery date and time

2.Our contract

When you place your order for products and/or services we will send you an email confirming receipt of the same. We will also inform you about the collection/delivery of the contracted products/services. You can, however, modify your order before the order enters the collection/shipping process.

We only sell products in quantities corresponding to the typical needs of an average household. In the case of companies that may eventually require larger quantities, orders must be previously consulted through our CONTACT page

3.Prices and availability

The prices of products and services displayed on the web include the legally applicable taxes (VAT), except for shipping costs that will be clearly shown to the customer before the payment of the same.

We include on the website information about the availability of our products, detailing it in the information page of each of the products (stock). When we process your order, we will inform you as soon as possible by email if any of the products included in your order are not available. In this case, we will not charge you any amount for that product.

The expected delivery times may, in some cases, suffer slight variations due to causes beyond our control.

4.Product/service information

The contracted services will be made exclusively by arteycostura.net or one of its collaborators. We recommend that you carefully read the information on each service contract sheet as well as the warnings and instructions accompanying the service before using it.

5.Our responsibility

Arteycostura.net and its owner María Angeles Jimenez, will not be responsible for (i) any losses that were not attributable to any breach by you, (ii) business losses (including lost profits, income, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred), or (iii) any indirect losses or losses of a consequential nature that were not reasonably foreseeable by both parties at the moment in which the contract of sale of the products or services between both parties was formalized.

Nothing in these conditions limits or excludes our liability in case of falsehood, or death or personal injury attributable to our negligence or fraud.

Also, arteycostura.net and its owner, will not be responsible for any delay or breach of its obligations arising from these conditions if such delay or failure was attributable to circumstances beyond our reasonable control. This provision does not affect your right to receive the product or service within a reasonable time. If the delay takes place prior to the referral of the product, arteycostura.net will not charge you any amount for the said product until it is sent to you, and you may cancel the order at any time prior to said delivery.

The terms and conditions of the warranty that arteycostura.net offers on its products vary depending on the person making the purchase: a “consumer” or another person who “acts for purposes that fall within the framework of their professional activity”, in accordance with the provisions of Directive 1999/44 / EC of the European Parliament and of the Council.

If you acquire the product in your “consumer” status, you are entitled to the guarantee of conformity provided in the legislation according to which the delivered goods must be in accordance with the contract, and to which the seller is legally bound (Legal Guarantee). Additionally, you may be entitled to any other warranty (the Commercial Guarantee) that may be granted by the manufacturer or a third party. Generally the name of the entity that grants the Commercial Guarantee as well as the terms and conditions of the same figure in the documentation included in the packaging of the product, which we invite you to read and keep in your possession. arteycostura.net will not be responsible for compliance with the obligations set forth in the Commercial Guarantee offered by third parties.

6. Applicable Law

These conditions will be governed and interpreted in accordance with the laws of the Spanish, expressly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods. Both parties agree to submit to the exclusive jurisdiction of the district courts of the city of Madrid, Spain.

7.Modification of the conditions of sale

We reserve the right to make changes to our website, our policies and our terms and conditions, including these Terms of Sale, at any time. You will be subject to the terms and conditions, policies and Conditions of Sale in force at the time you place your order, unless, by law or at the request of public authorities, you must make a change to these terms and conditions, Policies or these Conditions of Sale (in which case, such changes could be applicable to any orders you have previously made). If any of the present conditions were declared invalid, void or for any ineffective reason said condition will be understood to be excluded without such declaration affecting the validity or enforceability of the remaining conditions.

8.Resignation

In case of non-compliance by these terms of sale, and even if arteycostura.net may not exercise any rights available to you at that time, arteycostura.net may make use of such rights and actions on any other occasion in which you may not comply with these Conditions of Sale.

9.Minors of age

We do not sell products or services to minors. Children’s products that are eventually sold must be purchased by adults. Children under 18 may only use arteycostura.net under the supervision of a parent or guardian.
